Except Roberts wasn’t offered Arod. She was offered the whole list. She declined the whole list (didn’t even want to see it), EXCEPT to know about Arod, who she happened to be writing a book on at the time.

The WHOLE list was a WHOLE lot more newsworthy than just Arod’s name, but she wasn’t really interested in newsworthy, or disclosure for the public good, she was looking for something to sell her Arod book.

[312] I’m not letting my feelings about the Libby case one way or the other color my argument, I’m just saying that it is a really great illustration of the different sides of this debate. And I do believe that the other side of the argument is legitimate, just deeply flawed in the long run because of the precedent it sets.

To say the grand jury system defines our legal system is a bit of a stretch I think, thats not to say that it isn’t important but it doesn’t override the other rights afforded under the Constitution. Really this whole thing is more about the exclusionary rule than anything else.

[309] As flawed as you may think the grand jury system is, it defines our legal system and in doing so extends definitive rights. The first amendment does not trump these rights. A good prosecutor should absolutely hold journalists feet to the fire when their actions result in a needless violation of the privacy accorded by the grand jury. Without proper balance and restraint, all freedoms are useless because they infringe on each other. Reporters like Selena Roberts should be called to account for their borderline criminal behavior.

[309] and just to clarify, I’m not saying it is NEVER acceptable to reveal one’s sources…I just don’t think a reporter should be obligated to do so unless there are extraordinary circumstances at play.

the Libby case was really the best illustration of all of this I think.

[305] Well the grand jury system in and of itself is deeply flawed to begin with, some would argue unconstitutional although I wouldn’t go that far.

So at that point what you’re left with is a question of the legality/constitutionality of Roberts’ actions, I think any defense attorney worth their salt would be able to successfully make the argument that she has both the right and obligation to a) report upon material she comes across which is deemed “newsworthy” (and a positive steroids test by A-Rod certainly qualifies as such) and b) protect her anonymous sources.

You can try and set the precedent that would leave journalists in a state of confusion as to whether or not they’ll be thrown in jail for publishing reports of factually verified information, but I don’t think that’s a wise road to go down is all I’m saying. We came close with the “Game of Shadows” guys but it was resolved before it could get to that point.

[299] Freedom of the Press does include permission to trample over the rights guaranteed by the grand jury system. Prosecutors do have discretion to apply the law as they deem appropriate. Using some legal precedent and good old common sense, I’d like to think they could tell the difference between a whistle blower trying to uncover a transgression against the public good versus a smut writer trying to make money with a book.
